Architectural Control
  • chevron_rightI want to build on my lot, what do I need to do?
    Provide a written copy of your building plans along with a completed ACC checklist to the ACC Chairman.  Your plans must include copies of plot plan, elevation, landscape plan, drainage plan and a completed ACC checklist.  You must also provide a completion date.  Any changes to the plans must be submitted in writing to the ACC for approval. Your plans will be kept on file and not returned to you.  You must obtain written approval from the ACC prior to commencing any building and/or modifications.
  • chevron_rightHow long do I have to complete my landscaping?
    Landscaping must be completed when the home is completed.  Exceptions may be granted in case of seasonal restrictions.  Please contact the ACC in writing to request an extension for your landscape completion date.
  • chevron_rightHow long does the ACC have to review my plans?
    The ACC has 30 days from submittal of COMPLETE plans to review them and approve/reject the plans.  If the plans are rejected, they must be resubmitted and the ACC has 30 days to review them from the date of resubmission.  Declaration, Article XII Architectural Control Section 2.
  • chevron_rightWhen does the ACC meet?
    The ACC meets on the 2nd Wednesday of each month to review submitted plans.
  • chevron_rightWhere do I obtain the ACC checklist?
    You may download a copy of the ACC checklist found under the Documents section of this website.
  • chevron_rightChanges to landscaping and/or modifications to buildings.
    Any changes, repairs or modifications to landscaping and/or building exteriors, fences, walls, etc… that is different to plans previously approved by the ACC must be submitted in writing to the ACC along with a complete ACC checklist and approved by the ACC prior to commencement of any changes. (Declarations, Article XII, Architectural Control, Section 1)
  • chevron_rightCan I have a play set and/or trampoline in my back yard?
    Play sets and trampolines are permitted in back yards, provided they are maintained in good condition and not easily visible from the street.
  • chevron_rightCan I build a storage shed or guest house?
    Additional structures are subject to the approval of the ACC (Restrictive Covenants, Section C) and must be located within the building setback lines.  They must be constructed from materials as outlined in the Restrictive Covenants, Section D.
  • chevron_rightCan I have a swimming pool?
    In ground swimming pools are permitted providing they are inside the building set back lines. (Restrictive Covenants, Section E Landscaping-Swimming Pools)
Community Information
General
  • chevron_rightAre pets permitted?
    Yes. A house pet is defined as an animal that spends the night indoors. No animals or poultry of any kind are permitted to run free on any part of the neighborhood, including the SJCC golf course.  Owners are responbsible for cleaning up after their pets.
  • chevron_rightCan I hold a garage sale?
    No.  This is private property and not open to the general public. Homes are to be used as single family dwellings and only the casual guests of the families or their domestic employees or servants are permitted in the subdivision. 
  • chevron_rightWhen is trash pick up?
    Trash is picked up on Thursdays and Waste Management recommends you place your trash cans on the curb by 6 am to ensure pick up.
  • chevron_rightWhere can I store my trash cans?
    Trash cans must be stored in containers and screened from view according to the Declarations, Article III, Section 17.  If you do not wish to keep your trash cans inside your garage you may submit plans for a trash can screen to the ACC along with a completed ACC checklist. 
  • chevron_rightWho do I contact if my street light is out?
    The street lights are part of the common area and the responsibility of the HOA to maintain.  Please notify a board member if your street light is out, so we can have it repaired.

  • chevron_rightHow much are the Home Owner Association dues?
    Dues are $161.04 per quarter.  Of which $60 goes into the Road Fund.

  • chevron_rightWhy do we have a "Road Fund"?
    SJCCE Phase II is a private neighborhood.   The roads are part of the common area and owned by the HOA.  It is the responsibility of the HOA to maintain the roads.  This separate fund was set up to cover the future costs of road repair and maintenance.   In the case that the roads are damaged during the construction of a residence or by the Unit owner it is the responsibility of that Unit owner to repair the damage.  Failure to do so may result in the Unit owner being assessed for the repairs.
  • chevron_rightWill the HOA dues increase?
    The dues are not likely to increase in the next few years, but according to the Declarations, Article VI, Section 2, the dues can be increased up to 20% from the preceding year.
  • chevron_rightDo I have to pay dues if I don't build on my lot?
    Yes.  All owners are required to pay dues even if the lot is empty.
  • chevron_rightWhat happens if I don't pay my Home Owner Association dues?
    If you fall two or more quarters behind your account will be turned over to a collect agency, charged a late fee and/or a lien may be placed on your property according to the Declaration, Article VI Assessments, Section 6 and Article VIII Liens, Section 1.  In addition, the board of directors has the authority to suspend your voting rights for non-payment of assessments and fines.  (Please see Declaration, Article III Occupancy and Use of Units and Common Area, Section 21. Fines.)
  • chevron_rightWhy doesn't the Development Board Pay dues?
    According to the Second Ammended and Supplement Declaration, Article XIV, RESERVATION TO ENLARGE, Section 3. Reservation of Development Rights, e. Declarant reserves the right not to be subject to assessments for the Development Property Common Area until 85% of the units are sold; 
  • chevron_rightCan my dues/assessments be waived?
    No. 
     
    Please see Declaration, Article VI Assessments, Section 8. Debt a Personal Obligation of Assessments: No owner may waive or otherwise escape personal liability for the payment of the assessments provided for herein by the non-use of the Common Area or by the abandonment or leasing of its Unit.

    There are security cameras located at the guard shack that record incoming and outgoing traffic.  Cameras will be installed at the Rinconada gate in the near future.
